The difference between surgical complications and malpractice are that malpractice actually means negligence. It means that a healthcare provider fell below the acceptable standard of care and was negligent. Surgical complications can occur without negligence. There are foreseeable risks involved in all surgeries. Unless the complication was the direct result of negligence on the part of the provider, it is not malpractice.
