You can sue if the radiologist misreads your medical imaging. In fact, this is one of the more common claims for our practice, and it’s one of the simplest to prove because the radiology is a picture that preserves exactly what was there to be seen at the time, what should have been reported at the time, and what would have given other healthcare providers appropriate information to act on. So we can always, as long as the radiology images are preserved—and by law, they are required to be—we can always get that image, have a radiologist look at it now, and call it a look-back to see what was there at the time and what should have been reported.
