You can sue a hospital for a birth injury. The hospital is responsible for all of its direct employees, its agents, and apparent agents. Any of the hospital personnel in labor and delivery, which could include the nurses, it could include the sonographer, it could include any technicians who were involved, the hospital would always be responsible for those individuals. Depending on how you came to use the doctor who is delivering, the hospital also may be liable for the acts or omissions of the delivering physician.
