You can always bring a claim against a healthcare provider for prescribing the wrong medication. The analysis is a little bit more complicated in the sense that what you want to understand, first of all, is why and was it indeed wrong, and most importantly, whether there’s an adverse reaction. If a doctor prescribed the wrong medication and there was no injury, thank goodness, well then, while you are entitled to file a lawsuit, it would be very difficult to convince any jury that there was any harm. Medical malpractice cases are time-consuming, they’re expensive, they’re very litigious. In order to bring one, you need to make sure that not only do you have what we call negligence, or something that deviated from the standard of care, it also has to have caused an injury, and that injury generally has to be something that really affected your life in a material way.
