In order to initiate a failure-to-diagnose lawsuit, you typically need to get the case reviewed by a qualified medical expert. So, for instance, if the case is a failure to diagnose a stroke and a patient presents to the emergency department at the hospital with stroke-like symptoms, they are sent home, and then the stroke worsens over time. The initial thing that we do at our firm is, first, the lawyers themselves always review the medical records, and secondarily, we actually have an in-house nurse investigator that reviews the records with us in order to determine whether it’s the type of case that we want to send to a medical expert. In the example of a stroke case, we then send the case to a stroke expert, which would be a board-certified neurologist, typically that is academically affiliated with a major hospital that is well-respected. They would then review the records to assist us in determining whether there was a period of time in which, if the healthcare providers had made the appropriate diagnosis, the ultimate outcome in this case—meaning a stroke or a severe stroke—could have been avoided.
