I think the hardest element in a medical negligence claim to prove is whether there was a deviation from the standard of care. I think for laypeople, it’s hard for us to accept that healthcare providers can make a mistake. We’re incredibly vulnerable when we go to a hospital or go to a physician, and it’s an area that we most people don’t really know much about. So, I think ultimately proving to a jury that there was medical negligence and that someone deviated from the standard of care is probably the most difficult burden that we have to overcome.
