Our client arrived at Aventura Hospital after having a fall. He was a 70-year-old man who had a relatively innocuous fall. He arrived at Aventura, and Aventura did some testing and diagnostics, but ultimately they discharged him without identifying a pretty significant spinal injury that he had. By the time he was subsequently diagnosed, he was paralyzed. They discharged him, and other doctors made the proper diagnosis, but it was too late to save him. This poor man, who just retired from his job and was looking forward to spending his golden years with his wife, traveling and doing all these great things, was confined to a wheelchair for the rest of his life because Aventura failed to take the appropriate steps when he arrived there and when he was treated at Aventura Hospital.
At Aventura Hospital there were a variety of healthcare providers that had the opportunity to make the right diagnosis and provide the right treatment. Through a lot of work, due diligence, research, requesting the right records, and talking to the appropriate experts, we were able to identify all the healthcare providers who had a role in causing his injury. We’re very proud of the work that we do because sometimes what seems not necessarily so obvious at the beginning is obvious when you consult with the right experts and take the time to understand the medicine, understand the chronology of events, and speak with the right experts who can then guide you and say, “Listen, here’s what happened, here’s why it happened, here’s why it shouldn’t have happened.”
Ultimately, we’re very proud that we were able to hold all the healthcare providers responsible. Again, it doesn’t bring his health back; it doesn’t give him the ability to walk. But what it does do, and we’re proud that we were able to do this, is provide him with a measure of compensation to give him the resources he needs so he can live a decent quality of life, the best quality of life he could hope for under the circumstances. We’re very happy that we were able to do that. Had the healthcare providers at Aventura Hospital acted within the standard of care and done what would have been expected from other reasonable healthcare providers, our client would have walked out of Aventura Hospital and been able to walk for the rest of his life.
