You should file a birth injury lawsuit at the earliest opportunity, because there are statutory considerations. There is a two year, newer should have known statute when you first learn of something. There is a four year statute of repose. There is an exception for children, for minors, where you can get eight years. But that’s not for all of the damages, for example that would only protect the child’s actual pain and suffering and expenses but it would not take into account the parents own claim for what they have gone through and what they will always go through, because they have a profoundly injured child that they love dearly and that they have to take care of. So to protect everyone involved in the claim, it would be two years from the date you knew, or should have known of the negligence or four years from the date of malpractice practice.
